Vocus requested the domain name PRWEB.COM.UA.

The American company Vocus transferred the domain name PRWEB.COM.UA to it. This domain currently hosts a website for an online community of Ukrainian PR professionals and journalists. Information about thisappearedon the community website.

The letter from company representatives states the following:

Vocus is the registered trademark owner of "PRWeb" and owns the PRWeb domain name located at www.prweb.com, as well as other similar versions of such domain names. We hereby notify you that the use of Vocus's intellectual property, including the name "PRWEB" in the domain name, may violate the law. You must cease and desist from using the PRWeb trademark in any form or manner, including in the prweb.com.ua domain.

PRWEB.COM.UA community membersdiscovered, that there are many domains in different domain zones that use the name PRWEB.

If the PRWEB trademark was registered in Ukraine before the PRWEB.COM.UA domain name, the trademark owners can assert their rights to this domain in court. If the PRWEB trademark is not registered in Ukraine, the owners can also challenge their rights to the PRWEB.COM.UA domain. However, to do so, they will have to prove that the trademark is well-known or well-known in its niche. The State Department of Intellectual Property makes the decision regarding the well-knownness of a trademark (or its well-known status).

As a reminder, Ukrainian courts have been litigating the google.ua domain name for several years now, with Google Inc. proving its right to the domain in the Ukrainian .UA domain zone.
