A Moscow court denied a Swiss company the domain tissot.ru.

The court rejected Tissot AG's request to prohibit the use of the name "tissot" in the tissot.ru domain. Furthermore, the court refused to find the domain owner infringing Tissot AG's exclusive rights to the trademark and trade name. Accordingly, the court will not require the domain owner to pay 50,000 rubles in compensation.

The defendant was Holmrook Limited. In arguing their case, Tissot AG representatives stated that the company is a world-renowned manufacturer of watches and other timekeeping instruments and has owned the brand name since 1917.

Holmrook Limited registered its domain name long after it infringed the plaintiff's trademark and trade name.

It is noteworthy that the disputed domain tissot.ru is not in use.

Previously, the Moscow Arbitration Court prohibited Holmrook Limited from transferring rights to the tissot.ru domain to other parties or another registrar until the dispute is resolved.

In September of this year, Holmrook Limited was the defendant in a lawsuit filed by Swiss watchmaker Rado Uhren AG. The court then banned the company from using the domain and awarded the Swiss company 50,000 rubles in compensation. Earlier, the court upheld a similar claim by Swiss company Longines Watch Co. against Holmrook Limited for infringement of its trademark and the trade name "Longines."
