Samsung vs. Apple – the war continues
South Korean company Samsung, which is trying to ban sales of the iPhone 4S in Australia, has filed a lawsuit demanding access to the iPhone 4S firmware, along with all information about its agreements with leading Australian mobile operators.
Samsung's lawyers explained this demand by saying that this data could be evidence of violations of three patents of the Korean giant, which Apple had committed, and a compelling argument for banning iPhone sales on the "green continent."
However, the other party to the dispute, Apple, claims that Samsung agreed to license these patents on FRAND (Fair, Reasonable, and Non-Discriminatory) terms.
A court hearing on this matter is scheduled for November 4, 2011. As with the case against the ban on sales of the Samsung Galaxy Tab 10.1 tablet in Australia, Judge Annabelle Bennett will preside over this case. As a reminder, her verdict was not in favor of Samsung.
As previously reported,Samsung has already tried to get a banon iPhone 4S sales in Japan, France, and Italy. And since the Italian court dismissed the lawsuit, the Korean company's chances of success in banning the iPhone 4S in Europe are very slim.
