Not necessarily. The trademark owner determines its usage independently, and the phonemes of the specified characters may or may not appear in the domain name.
8. Should the trademark name be fully reflected in the domain name?
Not always. Trademarks have a distinctive feature—the part of the trademark that distinguishes it from others. It's important that the trademark's distinctive feature be reflected in the domain.
For example, the owner of the PUPKIN chain of electric kettle stores will be able to register the following domains: pupkin-chain-of-electric-chainikov-stores.ukr or pupkin.ukr, but will not be able to register chain.ukr or store-of-electric-chainikov.ukr, or electric-chainikov.ukr.
In controversial or ambiguous cases (for complex trademarks), the final word remains with the Domain Administrator.
9. If my trademark is read as the name of a country or city, can I register a .УКР domain?
No. Registration of domain name categories consisting of names of countries, cities, regions, etc. is already open, but applicants and registrants in these categories may only be official representatives of states or individuals who have received consent from local governments or their executive bodies.
Therefore, if your trademark is read as the name of a locality or region (for example, "Crimea," "Dnepropetrovsk," or "Italy"), but you do not have additional permission from government agencies, your application for registration of such a domain will be denied.
10. Who is the domain registered to and what documents are required?
By default, a domain is registered to the trademark owner. If there are multiple owners, registration can be done in the name of one of them (any of those listed on the certificate). If a domain is registered in the name of the trademark owner, no additional documents are required, as the owner's information is obtained from the Ukrpatent or Wipo database.
If you wish to register a domain name in the name of a representative, you must provide a copy of the license agreement with your application, which clearly states that the licensee has the right to register domains.
11. I pre-ordered a .УКР domain, but I don't have a trademark or have just applied for one. Can I register a domain in the .УКР zone?
No. Unfortunately, at this stage of pre-registration, you cannot register a domain in the .УКР zone without a trademark registration certificate. You will only be able to register a .УКР domain once registration becomes open.
12. How do I transfer a pre-order for a .УКР domain to another user on the NIC.UA website?
